Official Rules
THE CONTEST (“CONTEST”) ENTRY PERIOD BEGINS DECEMBER 8, 2008 AT 12:01 AM EASTERN STANDARD TIME AND ENDS JANUARY 12, 2009 AT 11:59 AM EASTERN STANDARD TIME (“CONTEST PERIOD”). THE VOTING PERIOD COMMENCES WHEN AT LEAST TWENTY (20) ENTRIES HAVE BEEN SUBMITTED AND ENDS JANUARY 13, 2009 AT 12:00 P.M. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. OPEN TO LEGAL RESIDENTS OF THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 13 YEARS OF AGE OR OLDER. VOID IN PUERTO RICO, GUAM, THE U.S. VIRGIN ISLANDS, AND WHERE PROHIBITED BY LAW.
Sponsor: SugarLoot (“Sponsor”) is the sponsor and administrator of the Contest and is responsible for the fulfillment of the prizes. SugarLoot is responsible for the collection, submission or processing of entries and the overall administration of the Contest. Entrants should contact SugarLoot with any questions, comments or problems related to the Contest.
Entry: To enter the Contest you must be a registered member of SugarLoot. There is no charge to become a member of SugarLoot. Through on-screen instructions you will be asked to provide information during the registration process including your first and last name, email address, city, state and date of birth. Members of SugarLoot are required to have their email addresses verified. AS A CONDITION TO WINNING A CONTEST, YOU MUST HAVE PREVIOUSLY VERIFIED YOUR EMAIL ADDRESS BY MEANS OF THE VERIFICATION LINK LOCATED ON THE CONTEST SITE. During the Contest Period, you may enter the “Most Courageous Moment” Contest by visiting the Contest channel at www.sugarloot.com (the “Contest Site”) and uploading a photo of you during one of your most courageous moments. YOU MUST BE IN THE PHOTO FOR YOUR ENTRY TO BE ELIGIBLE TO WIN. Entries must only depict your original work. You hereby represent and warrant that: (1) all entry material submitted is wholly original to and created by you, and has not been copied in whole or in part from any other work (2) the entry material is your exclusive work and does not infringe upon or otherwise violate the copyright, trademark, privacy, publicity or other proprietary rights of any third party; (3) you have the full and exclusive right and authority necessary to submit the entry material in the Contest and to grant the rights granted herein without permission from or payment to any third party; and (4) you meet all the eligibility requirements and that you have not engaged in any of the disqualifying activity set forth in these Official Rules.
You may enter the Contest only once. Additional entries will be disregarded. You may remove your entry at any time by clicking the "Remove" link at the top of the entry page. After removing an entry, you may replace it with a new entry, however any votes that you have previously garnered for the removed entry will be lost and of no effect.
Once entered, you will be given a direct link to the Contest Site that you may pass on to friends and family as well as post on blogs, forums and other websites to induce others to vote for you.
Without limiting any other term or condition in these official rules, any entry which in the sole opinion of SugarLoot is inappropriate or which otherwise violates SugarLoot’s Usage Policy or Terms of Service will be removed and the entrant disqualified. Automated or robotic entries submitted by individuals or organizations will be disqualified.
Other Eligibility Restrictions: Employees (and such employees’ immediate family or household members) of SugarLoot and its respective parents, affiliates, subsidiaries, prize suppliers, printers, distributors, advertising and promotional agencies are not eligible to enter the Contest.
Privacy: By entering the Contest, you agree to SugarLoot’s use of your personal information as set forth in its Privacy Policy at www.sugarloot.com/privacy.
Voting: Visitors to the Contest Site may view and rate entries on a scale of 1-10 with 10 being the highest affirmative grade. Voting for this contest ends on January 13, 2009 at 12:00 PM Eastern Standard Time. SugarLoot shall have the right in its sole discretion to maintain the integrity of the Contest including to void votes or disqualify entrants, for the following reasons:
a) Multiple votes from the same user from different IP addresses;
b) Use of mechanical or automated voting applications or scripts;
c) Fraudulent entry votes (using redirect link, disguised link, or other method to bypass the legitimate voting channels of the Contest);
d) Inappropriate conduct to induce voter action (for example but not limited to, the use of spam transmissions, harassment, or the payment or granting of consideration)
e) For any other reason as determined by SugarLoot in its sole discretion for insuring and maintaining the integrity and overall fairness of the Contest or as otherwise provided in these Official Rules.
Winner Selection: The entry garnering the highest average score will be the potential winner of the Contest. The highest average score is calculated by adding the rating set forth in each individual vote and dividing that number by the total number of votes cast for the applicable entry. An entry must have a minimum of 200 votes in order to be eligible for any prize award. In the event of a tie, a SugarLoot designated judging panel will determine the winner based equally on the following: (i) adherence to Contest theme and (ii) quality of creative expression.
The winner will be notified by email. The potential winner must accept the prize award within three (3) business days of notification. Any winner notification not responded to or returned as undeliverable may result in Prize forfeiture. The potential prize winner (or if the potential prize winner is a minor, then parent of such potential prize winner) may be required to sign and return an affidavit of eligibility and release of liability within five (5) days of receipt unless an extension is granted by SugarLoot in its sole discretion. In the event of non-compliance within this time period or if the prize is returned, refused, or returned as undeliverable or if the potential winner violates the Official Rules, then prize will be forfeited and the potential winner disqualified. The entry garnering the next highest average score will then be declared the potential winner. No substitution or transfer of a prize is permitted except by SugarLoot.
Prizes: One (1) Grand Prize winner – Prize winner will receive a $150 Barnes and Noble Gift Card subject to terms and conditions of the issuer and Confessions of an Ugly Stepsister Approximate Retail Value ("ARV") $16.00, Lost "ARV" $16.00, Mirror Mirror "ARV" $16.00, Son of a Witch "ARV" $7.99, Wicked "ARV" $7.99, and A Lion Among Men "ARV" $26.95. Total "ARV" for all prizes: $240.93
SugarLoot reserves the right to substitute the Prize, or portion of the Prize, for another prize of equal or greater value. The ARV of the Prize represents SugarLoot’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
General Conditions: Only one Prize per person per household will be awarded. The Contest is governed by the laws of the United States and New York. All federal, state and local laws and regulations apply. The Contest is not to be used in connection with any form of gambling. Prize will only be awarded and/or delivered to addresses within the United States. All taxes, fees, and surcharges are the sole responsibility of the prize winner. If, by reason of a typographical or other error, more prizes are claimed than the number set forth in these Official Rules, then the Contest judging panel will determine the winner based equally on the following: (i) adherence to contest theme and (ii) quality of creative expression to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded.
Except where prohibited by law, the winner grants (and agrees to confirm that grant in writing) permission for SugarLoot their advertising and promotional agencies, and those acting under their authority to use such winner’s name, photograph, voice and/or likeness, and winning entry (including the display, reproduction and distribution of the entry), for advertising and/or publicity purposes in all media and formats now known or hereafter discovered, worldwide and on the world wide web, without notice, review, approval, or additional compensation. Entrants further agree that SugarLoot, and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, suppliers, printers, distributors, and the respective officers, directors, employees, representatives and agents of each and any other person or entity related in any way to this Contest (together the “Contest Entities”) will have no liability whatsoever for, and shall be held harmless by entrants (and parent/legal guardian if entrant is a minor) against, any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for or participating in any prize-related activity. The Contest Entities expressly disclaim any responsibility or liability for injury or loss to any person or property in connection with the delivery and/or subsequent use of the prizes awarded. SugarLoot makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Sugarloot will not replace any lost or stolen prize items.
Conduct: The Official Rules will be posted at the Contest Site throughout the Contest. Entrants further agree to be bound by the decisions of the judging panel, which are final and binding in all respects. SugarLoot reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of any of the Contest or any website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SUGARLOOT RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitations of Liability: SugarLoot is not responsible for (a) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of submissions in the Contest, (b) any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, or (c) any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrants’ or to any other person’s computer related to or resulting from participating or downloading materials in the Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of SugarLoot which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then SugarLoot reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. In the event of a dispute concerning who registered online to participate in the Contest, the registration will be declared to have been made by the authorized account holder or the email address submitted at the time of registration. The authorized account holder is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide SugarLoot with proof that the potential winner is the authorized account holder of the email address. If a dispute cannot be resolved to SugarLoot’s satisfaction, the entry will be deemed ineligible.
